1. Introduction and Acceptance
These Terms and Conditions (“Terms”) govern your access to and use of AI Archetypes, including the free quiz, your archetype result, and any paid digital products, available at https://www.elyscel.com (the “Service”). The Service is operated by Elyscel Co., Ltd. (“we,” “us,” “our,” or “Elyscel”), a company registered in Thailand.
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
These Terms incorporate by reference our Privacy Policy and our Refund and Cancellation Policy, both available on our website. Together, these documents form the entire agreement between you and Elyscel regarding the Service.
2. Definitions
Service: means AI Archetypes, including the website, the free quiz, archetype results, and all paid digital products.
Free Quiz: means the free AI Archetypes assessment that classifies users into one of seven archetypes at no cost.
Unlocks: means the paid digital products (Unlock 1, Unlock 2, and the Bundle) that provide extended analysis and guidance.
Content: means all text, scoring methodology, archetype descriptions, dimension analyses, reports, designs, and other materials made available through the Service.
User / you: means any individual who accesses or uses the Service, whether or not they make a purchase.
3. Eligibility
The Service is intended for users aged 16 years and above. By using the Service, you represent and warrant that you are at least 16 years old. If you are under 16, you must not use the Service.
By using the Service, you also represent that you have the legal capacity to enter into a binding agreement under the laws of your country of residence. If you are using the Service on behalf of another person, you confirm that you are authorised to accept these Terms on their behalf.
4. The Service and the Nature of Your Results
AI Archetypes is a research-based psychometric assessment that classifies users into one of seven archetypes based on their relationship with artificial intelligence. The Service generates an archetype result, dimension scores, and a dependency indicator using a transparent, research-validated algorithmic scoring system.
Your results are provided for self-reflection, education, and entertainment purposes only.
The archetype result and all associated analysis:
are informational only and represent a generalised classification, not a clinical, diagnostic, or professional assessment;
are not medical, psychological, psychiatric, legal, financial, or career advice, and must not be treated as a substitute for advice from a qualified professional;
must not be used as the sole basis for any consequential decision, including but not limited to hiring, employment evaluation, admissions, credit, insurance, medical, or financial decisions; and
may not be accurate for every individual, as no psychometric instrument is perfectly precise.
You acknowledge that you use your results at your own discretion and that Elyscel is not responsible for any decision you make based on them.
5. Accounts and Access
The Service does not require you to create a user account. By design, we minimise the personal data we collect, as described in our Privacy Policy.
Access to paid Unlocks is granted upon successful payment confirmation and is linked to your browser session and your payment receipt rather than to a registered account. You are responsible for retaining your purchase confirmation. If you lose access (for example, by clearing your browser data or using a different device), we can assist you in recovering it; contact us at contact@elyscel.com. We are not liable for loss of access caused by circumstances within your control.
6. Purchases and Payment
The Free Quiz and your free archetype result are provided at no cost. Paid Unlocks are one-time purchases. The price and description of each product are displayed on the relevant product page before you complete your purchase.
All payments are processed securely by our third-party payment processor, Stripe, Inc. We do not store your full payment card details. Prices may be displayed in your local currency where supported; the final amount charged, including any applicable taxes or currency conversion by your bank or card issuer, will be shown at checkout.
Refunds and cancellations are governed by our separate Refund and Cancellation Policy, which forms part of these Terms. Please review it before making a purchase.
7. Intellectual Property
All Content, including the AI Archetypes name, logo, scoring methodology, archetype framework, dimension definitions, reports, text, graphics, and design, is owned by Elyscel Co., Ltd. or its licensors and is protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-commercial, revocable licence to access and use the Service and your purchased Content for your own personal use only.
Except as expressly permitted, you may not copy, reproduce, distribute, publish, sell, resell, sublicense, modify, create derivative works from, publicly display, or commercially exploit any part of the Content. You may share your own personal archetype result on social media for non-commercial purposes, provided you do not remove or obscure any attribution to AI Archetypes.
8. Acceptable Use
You agree not to:
use the Service for any unlawful, fraudulent, or harmful purpose;
reverse-engineer, decompile, scrape, data-mine, or attempt to extract the underlying scoring methodology, source code, or database of the Service;
use automated tools (bots, scrapers, or scripts) to access the Service or generate results at scale;
resell, sublicense, or commercially exploit the Service or any Content without our prior written permission;
use the Service or any result to make decisions about other individuals, including in hiring, evaluation, or screening;
attempt to gain unauthorised access to the Service, its servers, or related systems; or
interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure.
We reserve the right to suspend or terminate your access to the Service if we reasonably believe you have breached these Terms.
9. Disclaimers
The Service and all Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that the results, archetype classifications, or scores are accurate, complete, reliable, or suitable for any particular purpose. Any reliance you place on the Service or its results is strictly at your own risk.
Nothing in this section excludes or limits any warranty or right that cannot be excluded or limited under the law applicable to you as a consumer.
10. Limitation of Liability
To the fullest extent permitted by applicable law, the total aggregate liability of Elyscel Co., Ltd., its directors, employees, and agents arising out of or in connection with these Terms or your use of the Service shall not exceed the total amount you actually paid to us for the product giving rise to the claim, or, if you used only the Free Quiz, shall be limited to zero.
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, these limitations do not affect your mandatory statutory rights.
11. Indemnification
You agree to indemnify and hold harmless Elyscel Co., Ltd. and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with your breach of these Terms or your misuse of the Service. This obligation does not apply to the extent a claim arises from our own negligence or wilful misconduct, and does not limit your statutory consumer rights.
12. Privacy and Refund Policies
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and process your personal data, and our Refund and Cancellation Policy, which explains the conditions under which refunds are available. Both policies are incorporated into these Terms by reference and are available on our website. In the event of a conflict between these Terms and either policy on a specific matter, the more specific policy governs that matter.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, applicable law, or business practices. The version in effect at the time of your purchase is the version that applies to that purchase. When we make material changes, we will post the updated Terms on our website and update the “Effective Date” above. Material changes will be highlighted at the top of the page for at least 30 days after they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by and construed in accordance with the laws of Thailand. Subject to the paragraph below, you agree that the courts of Thailand shall have jurisdiction to resolve any such dispute.
Consumer protection. Nothing in this section deprives you of the protection of any mandatory consumer-protection provisions that cannot be derogated from under the law of the country in which you reside. If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, you also benefit from the mandatory provisions of the law of your country of residence and may be entitled to bring proceedings in the courts of that country.
We do not require disputes to be resolved through binding arbitration. We encourage you to contact us first at contact@elyscel.com so that we can try to resolve any issue informally and in good faith.
